Tu n’as pas été payé correctement ? Voici un modèle de lettre officielle à envoyer à ton employeur pour réclamer tes salaires et indemnités impayés — en anglais, pour qu’elle soit valable en Australie.
⚠️ Depuis le 1er janvier 2025, le sous-paiement intentionnel des salaires est un crime fédéral en Australie (Fair Work Act 2009). Les individus risquent jusqu’à 10 ans de prison et 1,65 million AUD d’amende. Les entreprises jusqu’à 8,25 millions AUD.
Avant d’envoyer la lettre
1. Réunis tes preuves
- Bulletins de paie, relevés bancaires, contrat de travail
- Planning/rosters (photos avant qu’ils disparaissent)
- Échanges écrits (SMS, emails) avec l’employeur
2. Identifie ta base légale
- Trouve ton Award sur calculate.fairwork.gov.au → “Pay calculator”
- Calcule tes taux via le P.A.C.T Pay Calculator du Fair Work Ombudsman
- Note le préavis requis et les taux penalty/overtime
3. Calcule le montant exact dû Remplis le tableau dans la lettre avec chaque semaine non payée ou sous-payée.
4. Fixe un délai 7 jours ouvrables est standard. Tu peux mettre 14 jours si tu préfères.
5. Envoie et conserve la preuve
- Email avec accusé de réception
- Ou courrier recommandé (garde le reçu)
- Garde une copie PDF de la lettre envoyée
